Property Settlement (Family Law)
The division of assets and liabilities between separating partners, whether married or de facto, covering property, superannuation and debts. It can be agreed informally, formalised by consent orders, or decided by a court. Until a mortgage is formally refinanced or discharged, both parties usually remain liable to the lender regardless of what the settlement says between them, which is the point where finance advice matters as much as legal advice.
