About Broker Codex

Broker Codex is a curated directory that allows consumers to search for and contact finance brokers, and allows brokers to create and maintain a profile by subscription. We are not a party to any engagement, agreement or transaction between a consumer and a broker. We do not provide credit assistance, credit services or financial product advice, and we do not receive commissions on any loan or finance arrangement. Any dealings you have with a broker are between you and that broker.

Registration and accounts

You must be a registered member to access certain features of our website, including creating a broker profile. When you register and activate your account, you will provide us with personal information such as your name, email address and business details. You must ensure this information is accurate and current. We will handle all personal information we collect in accordance with our Privacy Policy at brokercodex.com.au/privacy.

When you register, you will choose or be provided with login credentials. You are responsible for keeping these credentials secure and are responsible for all use and activity carried out under your account.

To create an account, you must:

• be at least 18 years of age;
• possess the legal right and ability to enter into a legally binding agreement with us; and
• agree and warrant to use the website in accordance with these Terms.

We collect personal information about you in order to provide you with access to the Broker Codex directory and services, to connect consumers with brokers, and for purposes otherwise set out in our Privacy Policy at brokercodex.com.au/privacy. We may disclose that information to third parties that help us deliver our services (including hosting, payment, identity verification and email providers), to brokers you choose to enquire with, or as required by law. If you do not provide this information, we may not be able to provide all of our services to you. By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in the Privacy Policy and these Terms.

Broker subscriptions and payments

Brokers may subscribe to list a profile on Broker Codex for a recurring fee. Subscription fees, billing intervals and any applicable discounts are as described at the point of subscription. Payments are processed by our third party payment provider; we do not store your full card details. Where a promotional discount applies, the terms of that discount (including its duration and any eligibility conditions) are as described at the point of subscription and in any related agreement between us and the broker. You may cancel your subscription in accordance with the cancellation options made available in your account.

In Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms purports to modify or exclude the conditions, warranties, guarantees and other legal rights under the Australian Consumer Law and other laws. Any other warranties or conditions not guaranteed by the Australian Consumer Law are expressly excluded where permitted, including liability for incidental or consequential damages.

Accuracy, completeness and timeliness of information

The information on our website is not comprehensive and is intended to provide a summary of the subject matter covered. Broker profiles are authored by brokers themselves, and we do not warrant the accuracy or completeness of profile content. While we use reasonable attempts to ensure the accuracy and completeness of the information on our website, to the extent permitted by law (including the Australian Consumer Law) we make no warranty regarding the information on this website. You should make your own enquiries before engaging any broker.
